Welcome to Ope430! These Terms of Service ("Terms") govern your access to and use of the website located at www.ope430.com and the Ope430 app (collectively, the "Services"), operated by Ope430, LLC ("Ope430," "we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our Services.


1. ELIGIBILITY

You must be at least 13 years old to use our Services. By using the Services, you represent and warrant that you meet the eligibility requirements.


2. USE OF SERVICES

You agree to use our Services only for lawful purposes and in accordance with these Terms. You will not:

  • Use the Services in any way that violates any applicable law or regulation

  • Interfire with or disrupt the Services or servers/networks

  • Attempt to gain unauthorized access to our systems or other users’ data

  • Use the Services to store, distribute, or transmit any malicious software or content


3. ACCOUNT REGISTRATION

To access some features, you may need to register for an account. You agree to provide accurate, complete, and updated information. You are responsible for maintaining the confidentiality of your account and password.


4. LICENSE AND INTELLECTUAL PROPERTY

We grant you a limited, non-exclusive, non-transferable license to access and use our Services for personal, non-commercial purposes. All content, trademarks, software, and other intellectual property on our Services are the property of Ope430 or its licensors and are protected by copyright and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Services without our prior written consent.


5. USER CONTENT

You may upload or submit content ("User Content"). You retain ownership of your User Content, but by submitting it, you grant Ope430 a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content solely for the purpose of operating and improving the Services.

You are responsible for your User Content and represent that you have the rights to share it.


6. SUBSCRIPTIONS AND PAYMENTS

Some features of our Services may require payment. By purchasing a subscription, you agree to pay all applicable fees and taxes. Prices and features are subject to change. Subscriptions may renew automatically unless canceled before the renewal date.

All purchases are subject to our Refund Policy.


7. TERMINATION

We may suspend or terminate your access to the Services at any time, without notice, if you violate these Terms or use the Services in a harmful or abusive manner. You may also stop using the Services at any time.

Upon termination, your right to use the Services will cease immediately.


8. COOKIE POLICY

Ope430 uses cookies and similar technologies on our website and app to improve your experience, analyze usage patterns, and support marketing efforts.

9. REFERRAL PROGRAM TERMS

Eligibility: Any registered user of Ope430 with an active account may participate in the referral program.

How it works:

  • Each user receives a unique referral link.

  • When a new user signs up using your link and completes a qualifying action (e.g., paid download or subscription), you earn referral credit.

  • Referral rewards may include discounts, free access, or other promotional benefits.

Rules:

  • Self-referrals or fraudulent signups are strictly prohibited.

  • Ope430 reserves the right to suspend or terminate accounts involved in abuse of the program.

  • Rewards are non-transferable and may be subject to expiration.

We may modify or cancel the referral program at any time, with or without notice.


10. CONSENT TO USE OF PERSONAL DATA

By using the Services or submitting information through forms, you consent to the collection, storage, and processing of your personal data as described in our Privacy Policy.

You agree that Ope430 may:

  • Use your information to operate and improve our Services

  • Contact you with updates, offers, and relevant content

  • Share limited information with third-party service providers for operational purposes

11. DISCLAIMER OF WARRANTIES

The Services are provided "as is" and "as available." We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Services will be uninterrupted or error-free.

Lifetime Access Clause – Founders' Deal 500 (para los primeros 500 clientes)

By purchasing a Founders' Deal 500 license, you are granted a lifetime access to the Ope430 software under the following terms:

“Lifetime” refers to the duration in which the Ope430 software remains commercially available and technically operable. While we intend to support the product for as long as it provides value, we reserve the right to discontinue access in the event of extraordinary circumstances, including but not limited to:

* Significant shifts in operating system technologies or security standards,

* Catastrophic events beyond our control (also known as “Acts of God” — think natural disasters, solar flares, or that time Harvey Specter sued the entire universe),

* Business closure or structural changes that make continued service unsustainable.

In such cases, we’ll do everything reasonably possible to inform users in advance and offer alternative solutions.

Founders' Deal 500 licenses are non-transferable, and refundable only under the terms stated in our Refund Policy.

By purchasing the Founders' Deal 500 , you agree to these terms.


12. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Ope430 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

Our total liability for any claim related to the Services shall not exceed the amount you paid us in the 12 months preceding the claim.


13. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Ope430 and its affiliates, directors, employees, and agents from and against any claims, damages, obligations, losses, or expenses arising from your use of the Services or your violation of these Terms.


14. GOVERNING LAW

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles. You agree to submit to the exclusive jurisdiction of the courts located in Miami-Dade County, Florida.


15. CHANGES TO THESE TERMS

We may update these Terms from time to time. If we make significant changes, we will notify you by email or via our Services. Continued use of the Services after changes become effective means you accept the new Terms.
